This privacy policy applies to the processing of personal data that Logicode (hereinafter, 'Logicode') carries out on its clients within its websites, apps, and any other digital platform or electronic medium, including the processing of data of social media users and based on their relationship with Logicode. For what purpose will your personal data be processed?

a) In the case of processing customer and user data within Logicode's digital platforms

Within Logicode's digital platforms, the collection and processing of the user's personal data will be carried out, depending on the relationship with the user, for the following purposes:

In the case of user registrations, to provide access and use of the digital platform and the contracting data and contact information available to said user, and compliance of the legal obligations of Logicode Logistics S.L. as a provider of information society services.

Likewise, user browsing data and cookies may be processed for the purposes of improving your accessibility as a user, personalizing and analyzing your browsing, as well as to display advertising and ads based on your interests, including in advertising spaces on third-party platforms (e.g., social networks, internet search engines, etc.) in accordance with our cookie policy and the privacy policies of said platforms to which access to said cookies is provided.

Other specific purposes indicated within the data collection forms within the digital platform and without which Logicode will not be able to process the form in question.

In the event of contracting services or products through the digital platform, we inform you The purpose of this agreement will be to manage your relationship with Logicode, the provision of the requested services, customer service, and, in general, compliance with the obligations of the Agreement. However, Logicode will always grant the Client the opportunity to allege anything it deems relevant in order to defend its right or interest. In the event of non-payment, Logicode may report it to said files, in compliance with current legislation.

Logicode may, with the user's consent, update and enhance the user's personal data by acquiring databases from publicly accessible sources, which allow for improved relationship management and contact with the user.

Logicode will also process the data. personal data with the purpose of offering, by the means provided or through third party platforms contracted by Logicode and accessible by the user, including electronic means, in a segmented and personalized way, information about the energy supply, products and services, own or of third parties promoted by Logicode, if you have consented, of an energy, telecommunications, financial, home and entertainment nature, for which Logicode may use automated support systems and other means that allow defining profiles of target audiences for campaigns, activities or actions, using for this purpose information from Logicode as well as iInformation from third-party sources, if the user has also consented to it. b) In the case of processing potential customer data in promotions, communication campaigns, and events

Logicode may process the data collected from its potential customers for various purposes depending on the context of the activity carried out. Like this:

In the case of promotions and raffles, as well as in the organization of events, the purpose is the one defined in the participation rules of the promotion and raffle, or of the specific event, as well as, where appropriate, the publication and dissemination, with the consent of the interested party, of their name, surname, image, voice, or any other data that may be necessary to publish for the correct management and wider dissemination of the event or promotion through the means of communication that Logicode deems appropriate (intranet, newsletters, press, website, social networks, etc.), including those located in foreign countries with the due legally required guarantees, as well as the sending of commercial communications and profiling if they have consented to it.

In the case of communication campaigns, data collected from publicly accessible sources based on Logicode's legitimate interest or collected directly from the interested party or from third parties with their consent, may be used by Logicode to send commercial communications, according to their commercial profile, if if you have consented to it, relating to the supply of energy, products, services, as well as sporting, cultural and charitable activities in which Logicode participates. These communications may be made through the contact methods obtained, conventional or electronic, or through third-party platforms contracted by Logicode and accessible by the user, such as social networks, internet search engines, etc.

How long will we retain your data?

a) In the case of processing customer and user data within Logicode's digital platforms

The personal data provided by the user for the contracting of products and services will be processed by Logicode for the duration of the contractual relationship with the customer, which will begin at the time of formalization of the Contract(s) and will end, regardless of the supply period, once all reciprocal contractual obligations have been fulfilled and for at least a period of 3 years after termination of the same in compliance with applicable legislation.

If the user has consented, their data may be processed for commercial communications purposes, for a period of 2 years after the termination of their contracts or after the cancellation of the user who does not have current contracts with Logicode.

For the remaining users registered on the different platforms (web, apps, etc.), their data will be kept within our digital platforms until the cancellation of said user is requested.

All these periods are understood without prejudice to the data retention obligations required by the applicable legislation in each case for the attention of the responsibilities arising from the processing.

b) In the case of processing the data of potential clients in promotions, communication campaigns, and events

If the data comes from third-party sources, the retention period will be that indicated by the information provider, generally coinciding with the validity periods of the publicly accessible source used (generally one year) or the duration of the communication campaign.

If the data comes directly from the interested party, this data will be retained for the purposes of carrying out commercial communications for 2 years after data collection.

All these periods are understood without prejudice to the obligation to block during the period of attention to the responsibilities derived from the processing in accordance with current legislation.

What is the legitimacy for the processing of your data?

The legitimacy for the processing of your data isthe consents obtained from the user or potential customer, those arising from the use of the digital platforms, the contracting of products or services, the regulations applicable to the supply of electricity, gas, and similar products and services, and any other regulations that may be applicable at any time.

User consents are obtained both at the time of user registration and in the various contracts or requests made within the digital platform, while those of potential customers are obtained within the forms for collecting their data. These consents may be modified at any time by the user/potential customer by exercising their rights. Processing may also be based, in the case of customers with current contracts, or in the case of obtaining data on potential customers from publicly accessible sources, on Logicode's legitimate interests in offering energy supply and related products and services, loyalty initiatives, including sporting, cultural, and charitable initiatives in which Logicode participates, profiling to offer products or services similar to those contracted, and, in the specific case of customers, to communicate this data to third-party companies to carry out administrative procedures for customer admission, fraud prevention, and debt collection and claims.

Legitimate interest includes the processing of data of users of digital platforms for the management of security and access control of supporting information systems.

If, in order to carry out any management of the contract or specific request, it is necessary for the customer to provide personal data of persons other than the data subject, the customer must inform them in advance and expressly of the content of this policy and obtain their prior consent for the processing of their data. data.

To register as a user on Logicode's digital platforms, users must declare that they are of legal age, as access to these platforms is restricted to minors. Therefore, by registering, you represent and guarantee that you are of legal age. In any case, Logicode is exempt from processing data about minors without the consent of their parents or guardians.

To access certain services, you must register as a registered user of the digital platform. The data used to complete the Registration Form is provided freely and voluntarily, so the data must be true and accurate. The user agrees to use their username and password diligently and not to make them available to third parties, and to notify Logicode as soon as possible of any loss, theft, or any risk of access to them by a third party.

The data that the user provides to contract services or products is necessary for maintaining the contractual relationship, and failure to provide it would make it impossible to manage said relationship.

The user is responsible for the accuracy of the data provided and must request its modification whenever necessary to ensure proper processing of the data, the correct provision of the contracted services, and the execution of communications.

To which recipients will your data be communicated?

a) In the case of processing customer and user data within Logicode's digital platforms.

In the case of contracts, the data necessary to manage network access will be communicated to the Company. Distributor and will be incorporated into a file under its responsibility (Supply Point Information System – SIPS), which may be accessed by those determined by law at any given time.

Logicode also works with third-party service providers, such as sales channels, administrative support, telephone service, banks, debt collection agencies, marketing and advertising, auditing, and others who, in certain cases, may access your data, with the necessary guarantees, for processing purposes.

In the event of non-payment by the Client for its services, Logicode may notify the managers of the financial solvency and credit files in compliance with applicable regulations. It may also transfer the data to the competent authorities and agencies in compliance with the corresponding legal and tax obligations. The data relating to possible supply contracts will also be communicated to the Tax Administration for the purposes provided for in General Tax Law 58/2003 and/or Law 36/2006, of memeasures for the prevention of tax fraud. Likewise, pursuant to Royal Decree 897/2017, which regulates, among other matters, the status of vulnerable consumers, the personal data of these customers may be communicated to the agencies responsible for the protection of vulnerable consumers for the purposes of implementing the measures contemplated therein, as well as to any other Administration for the purpose legally determined.

The user's personal data may be accessed or communicated to other companies located in third countries outside the European Union. For these purposes, please be advised that Logicode does not currently have call center services contracted with third-party providers who occasionally provide their services from countries outside the European Union. Such access is considered an international data transfer and is covered by the authorizations of the Spanish Data Protection Agency TI-00114-2010 and TI-00166-2009 in light of the guarantees provided by said providers.

The Client's personal data may be accessed or communicated to other companies located in third countries outside the European Union. For these purposes, it is reported that Logicode Representatives may communicate with each other through their social media profiles, the information of which may be located in countries outside the EU. In these cases, the data necessary for communication will be processed in accordance with the guarantees of Article 44 of the GDPR and will be communicated by the social network itself to its users or based on the user's unequivocal consent granted directly to Logicode.

b) In the case of processing potential customer data in promotions, communication campaigns, and events

In the case of product and service campaigns, data may be accessed by third-party service providers of Logicode for the purposes of campaign management and sending commercial communications, as well as transferred to third-party collaborators who prescribe Logicode products or services for monitoring the campaign carried out in collaboration with them.

In the case of participation in events and activities, data may be accessed by third-party service providers or third-party collaborating companies or organizers for the purposes of managing and promoting the activity.

Third-party service providers include communication and media agencies, event agencies, photographers, insurance companies, etc.

What are your rights when you provide us with your data?

The interested party may exercise their rights of access, rectification, or, where appropriate, request the deletion of their data when they are no longer necessary for the purposes for which they were collected, among other reasons.

The interested party may request the restriction of the processing of their data in the circumstances established in Art. 18 of the GDPR, in which case they will only be retained for the exercise or defense of potential legal claims.

The data subject may withdraw the consent given at any time, objecting to the processing of their data for a specific purpose, without affecting the lawfulness of the processing based on the consent prior to its withdrawal, or object to it, in which case their personal data will only be retained for the exercise or defense of potential legal claims. In the case of objecting to the sending of commercial communications, these communications will include simple and free means of objecting to the receipt of subsequent communications through these specific means. Likewise, the data subject may object to any type of sending of commercial communications by directly exercising their right to object through the Logicode contact points detailed below.

The data subject may contact Logicode to challenge any decision that they believe may affect their rights and freedoms or legitimate interests and that was based on an automated decision, including profiling. This right allows you to challenge this decision and obtain a direct response from Logicode's managers.

The interested party may request Logicode to transfer their personal data, obtaining an electronic copy of said data either by sending it to the email address they provide or within the corresponding section of the Logicode website.

Logicode's digital platforms sometimes provide links to other digital platforms or content owned by third parties. Logicode is not responsible under any circumstances for the results that may arise for the USER from accessing said links.

The USER, and in general any natural or legal person who intends to establish any technical link from their digital platform to any of Logicode's digital platforms, must obtain prior written authorization from Logicode. The establishment of the link does not imply, under any circumstances, the existence of a relationship between Logicode and the owner of the platform on which the link is established, nor the acceptance or approval by Logicode of its contents or services.

Binding Corporate Rules (BCRs)

Data transfers are carried out in accordance with applicable data protection laws and Binding Corporate Rules ('BCRs'). The Logicode Group's BCRs reflect European data protection legislation (General Data Protection Regulation).
